Abuja, NIGERIA — In a fierce assertion of his rights, Senator Peter Nwaoboshi has unleashed a scathing rebuke against the Inspector General of Police (IGP), Kayode Egbetokun, accusing the top law enforcement official of brazenly ignoring a valid court order. Nwaoboshi, a respected former member of the Nigerian Senate, has vowed to take decisive legal action against the IGP for what he describes as a “blatant disobedience” of a ruling by the Federal High Court in Abuja.
The matter at hand revolves around a court order issued under Suit No: FCT\HC\CV\2916\2024 and Motion No: M\9638\2024, which Nwaoboshi’s legal team claims was willfully disregarded by the police. The court order, which was issued in July 2024, sought to enforce the fundamental rights of Nwaoboshi, as guaranteed by Nigeria’s Constitution. However, despite the court’s clear instructions, the police have failed to comply with the directive, prompting accusations of institutional recklessness.
“This is the height of official irresponsibility,” Nwaoboshi declared in a statement. “It is an affront to our judicial system and a direct assault on the rule of law, which should be the foundation of any democratic society.”
According to the senator, his legal team is now in the process of filing an application for committal for contempt of court against the Inspector General of Police, as stipulated by Section 72 of the Sheriff and Civil Process Act, Cap. S6 LFN 2004. The senator’s lawyers argue that failure to adhere to a court order constitutes contempt, a serious offense under Nigerian law. “An order of court, whether right or wrong, must be obeyed unless it is set aside by the same court or on appeal,” Nwaoboshi emphasized.
The court order in question, which Nwaoboshi’s legal team asserts was properly served to the IGP’s office, had demanded specific action from the police in relation to a case concerning Nwaoboshi’s fundamental rights. The senator’s lawyers argue that the refusal to comply with the court’s decision undermines the integrity of Nigeria’s judicial system and weakens the rule of law.
In a strongly worded statement, the senator underscored the gravity of the situation: “If the orders of a competent court are treated with such disdain, it sends a dangerous message that no one, not even the police, is bound by the law. This sets a perilous precedent for our democracy.”
Legal experts have warned that such blatant disregard for judicial orders is not only a violation of the Constitution but could also destabilize the nation’s legal system, emboldening other public officials to flout the law without fear of reprisal.
The petitioners, who include Nwaoboshi and his legal team, have expressed concern over the potential erosion of judicial credibility if the IGP’s actions go unchecked. “The dignity and honor of the court cannot be preserved if its orders are ignored or disrespected,” they argued.
